TERMS AND CONDITIONS OF SALE (T&Cs)
Between: The agricultural sole proprietorship "La Ferme de Mondéry", located at Lieu-dit Mondéry, 32160 Couloumé-Mondébat, France, registered with the Mutualité Sociale Agricole, SIRET n° 525 220 539 00023, represented by Ms. Anne-Laure Poux as Manager. The business can be contacted via the contact form available in the website menu. Hereinafter referred to as the "Seller".
And: The natural or legal person purchasing the business's products, hereinafter referred to as the "Client".
It has been exposed and agreed as follows:
Article 1 – Object and General Provisions
These Terms and Conditions of Sale (T&Cs) determine the rights and obligations of the parties regarding the online sale of products offered by the Seller via the website www.ferme-mondery.com. The Seller reserves the right to modify these terms by publishing a new version on the website. The applicable T&Cs are those in effect on the date of payment for the order. Acceptance of these T&Cs is confirmed by a mandatory checkbox and validation click. The Client declares they are legally able to contract under French law. Records stored by the Seller constitute proof of all transactions.
Article 2 – Pricing
Product prices are indicated in Euros, including all taxes (TTC - VAT and other applicable taxes), on the order page, excluding shipping costs. For international orders, customs duties or other import taxes may be applicable; these are not the responsibility of the Seller and shall be borne entirely by the Client. Delivery costs are at the Client's expense.
Article 3 – Ordering Procedures
A client account must be created for the first order. Subsequent orders require logging in with an email address and password. The Client selects the product and its characteristics (size, color), adds it to the cart, and proceeds to "Checkout." A summary of the order will be displayed. The Client must then confirm the delivery method and payment choice before clicking "Confirm my order." A confirmation email will be sent for the order, payment, and shipment. The Client agrees to provide truthful identification details. The Seller reserves the right to refuse any abnormal order. Placing an order implies full acceptance of these T&Cs.
Article 4 – Products and Services
Essential product characteristics and prices are available on the website. The Seller agrees to honor orders within the limit of available stocks. If a product is unavailable, the Client will be informed. Photographs and illustrations are for informational purposes only and are not contractually binding.
Article 5 – Retention of Title
The products remain the sole property of the Seller until full payment of the price has been received.
Article 6 – Delivery Terms
Products are delivered to the address provided during the order process within the specified timeframe (excluding preparation time). The Client is notified of the shipment by email. Packages are shipped via La Poste (Colissimo with tracking). It is the Client's responsibility to notify the carrier of any reservations regarding the delivered product (e.g., damaged package).
Article 7 – Right of Withdrawal
In accordance with the law, the Client has 14 days from the receipt of the package to exercise their right of withdrawal without providing a reason. The Client must inform the Seller via the website contact form. This right does not apply to personalized or custom-made items. If the right is exercised, the full amount (product price + initial shipping) will be refunded; however, return shipping costs are the responsibility of the Client. Products must be returned in their original, complete condition. Refunds will be issued by check.
Article 8 – Payment Methods
Payment is due at the time of ordering. The Client may pay by credit card (via PayPal), check, or bank transfer. Cards issued by banks outside of France must be international bank cards. By providing banking information, the Client authorizes the Seller to debit the total amount of the order.
Article 9 – Warranties and Refunds
The Seller provides warranties for legal conformity and hidden defects. The Seller will refund or exchange products that are defective or do not match the order. Refunds will be issued by check.
Article 10 – Force Majeure
The Seller’s obligations will be suspended in the event of a "force majeure" or act of God that prevents execution. The Seller will inform the Client as soon as possible.
Article 12 – Protection of Personal Data
In accordance with the "Informatique et Libertés" law, you have the right to access, modify, oppose, and correct your personal data. Data collected (email, address, etc.) is used solely for the purpose of fulfilling your order. Your data will never be transmitted or sold to third parties.
Article 13 – Governing Law
All clauses in these T&Cs and all purchase/sale transactions are governed by French Law.
